1. Agreement to these terms

These Terms of Use ("Terms") govern your access to and use of the LearnSpace website and student/tutor portals (together, the "Platform"), operated by [Church Name]. By registering a student, signing in as a tutor, or otherwise using the Platform, you agree to be bound by these Terms. If you are a parent or guardian registering a student, you are agreeing to these Terms on behalf of yourself and your child.

Please also review our Privacy Policy and Child Safety Policy, both of which are incorporated into these Terms by reference.

2. What LearnSpace is

LearnSpace is a free, community-supported educational enrichment program. We connect K–12 students with screened volunteer and paid tutors for Math and English Language Arts practice, aligned to SBAC expectations. The Platform includes a student portal (assignments, grades, tutor feedback, and a moderated Q&A board) and a tutor portal (posting assignments, grading, a professional tutor-to-tutor network, and messaging).

LearnSpace is not a licensed school, accredited educational institution, or a substitute for a child's regular schooling. We do not guarantee any particular academic outcome, grade improvement, or test score.

3. Eligibility and accounts

  • Students under 18 must be registered by a parent or legal guardian, who is responsible for the accuracy of the information provided and for supervising their child's use of the Platform.
  • Tutors must be approved by a program teacher before their profile is visible to students, which may include a credentials review and, for volunteer roles, a background check.
  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • You must provide accurate information when registering and keep it reasonably up to date.

4. Acceptable use

When using the Platform, you agree not to:

  • Post content that is abusive, harassing, discriminatory, sexually explicit, or otherwise inappropriate for an educational setting involving minors
  • Attempt to contact a student or tutor outside the Platform's own messaging tools
  • Share your account, impersonate another person, or misrepresent your identity or credentials
  • Upload content you do not have the right to share, or that infringes someone else's intellectual property
  • Attempt to access another user's account or data, or interfere with the normal operation of the Platform

Conduct expectations specific to student and tutor interactions — communication rules, reporting, and consequences — are set out in full in our Child Safety Policy, which applies alongside these Terms.

5. Tutor network and posted content

Tutors may post educational content, comments, and reactions within the tutor-to-tutor network. This space is separate from — and does not affect — the reviews and feedback students leave about a tutor's sessions. You retain ownership of content you post, but you grant LearnSpace a license to display it within the Platform for as long as your account is active. We may remove any post, comment, or profile content that violates these Terms, and a teacher may review reported content and take action on it.

6. Volunteer and paid tutor terms

Volunteer tutors provide their time without compensation from LearnSpace. Paid tutors set their own stated rate, which is disclosed on their public profile; LearnSpace does not process payments on a tutor's behalf, and any payment arrangement is between the tutor and the student's parent/guardian directly. LearnSpace does not guarantee tutoring availability, session frequency, or a minimum number of students for any tutor.

7. No warranty

The Platform is provided "as is." While we take reasonable steps to keep it available, accurate, and secure, we do not warrant that it will be uninterrupted, error-free, or free of all security vulnerabilities. Tutor credentials shown on the Platform are self-reported by the tutor unless otherwise noted, and LearnSpace's review of them does not constitute a professional certification or guarantee of tutoring quality.

8. Limitation of liability

To the fullest extent permitted by law, LearnSpace and [Church Name] are not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability arising from gross negligence or willful misconduct.

9. Suspension and termination

We may suspend or terminate any account that violates these Terms, the Child Safety Policy, or applicable law, including after a substantiated report. Parents/guardians and tutors may request account deactivation at any time by contacting us; see our Privacy Policy for how account data is handled after deactivation.

10. Changes to these terms

We may update these Terms from time to time. When we do, we will post the updated version on this page with a new effective date. For material changes, we will notify parents and tutors by email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
